The petitioner apprehends his arrest in connection with Paraiya P.S. Case No. 85 of 2019 registered under Sections 302, 307, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused has already been allowed bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 3695 of 2020 on 18.09.2020.

Having considered the above facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below

Patna High Court CR. MISC. No.17765 of 2021(2) dt.04-01-2022 2/2 within a period of four weeks from today, on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Gaya in connection with Paraiya P.S. Case No. 85 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C. as well as subject to the following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the Trial Court.
