====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 23-06-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 147, 148, 149, 323, 448, 324, 325, 326, 307, 380, 504, 506 of the I.P.C. Petitioner is in custody since 01.09.2020. Allegation is that he gave a blow with iron rod causing injury at the head of husband of the informant. Initially, the doctor had reported that the injury was laceration one. However, subsequently a private hospital reported that injury was fracture of left frontal bone. Investigation of the case is already complete. There is no allegation of repetition of blow.

In absence of any material to substantiate that the petitioner is going to tamper with the evidence, let the petitioner,

Patna High Court CR. MISC. No.17297 of 2021(3) dt.23-06-2021 2/2 above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Dhaka P.S. Case No. 336 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
