The petitioner apprehends his arrest in a case registered for the offence under Section 379/411 of the Indian Penal Code.

As per the prosecution case, two trucks of the petitioner were used for transportation of sand and fine amount was calculated by the Department of Mines of both trucks were Rs. 2,05,350/- and Rs. 2,58,850/- respectively. By filing supplementary affidavit, learned counsel for the petitioner submits that petitioner has already deposited aforesaid fine amounts through challan and same was acknowledged by the Mining Department, vide letter no. 1436 dated 17.08.2022 (Truck Registration No. BR21GA-9302) and vide letter no. 1437 dated 17.08.2022 (Truck Registration No. UP65HT-7541) respectively.

Let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Nawada in connection with Warisaliganj P.S. Case No. 289 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
