Singh, learned senior counsel appearing on behalf of the petitioner and Mr. Umeshanand Pandit, learned APP appearing on behalf of the State.
2. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 140(1), 103(1), 238 and 61(2) of the B.N.S..
3. As per prosecution case, on 11.09.2025, informant got to know that all the F.I.R. named accused persons, including this petitioner and some unknown persons, took away Subodh Kumar, Dhiraj Kumar, Lovely Kumari and Sudhanshu Kumar. On 12.09.2025, dead body of informant's son, namely Subodh Kumar and Lovely Kumari was found near the railway track.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.7381 of 2026(3) dt.16-03-2026 2/3 behalf of the petitioner that petitioner is quite innocent and has committed no offence. Informant is not an eye witness to the occurrence and petitioner has falsely been implicated in this case merely on the basis of information given by one Pramod Kumar. During investigation, Dhiraj Kumar, who was also alleged to have been kidnapped by the accused persons, was recovered and in his statement, he has not named this petitioner as one of the kidnapper. Moreover, petitioner is none else than grandmother of deceased Lovely Kumari. Petitioner is a lady and claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, materials that have surfaced during investigation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount
