The petitioner has preferred this application for grant of regular bail in a case registered under sections 8, 20(b)(ii)(c), 22 and 25 of the N.D.P.S. Act, sections 25(1-B)(a) and 26 of the Arms Act and sections 3, 4 and 5 of the Explosive Substances Act.
As per the prosecution case, 4.5 kgs of ganja, a single barrel gun besides other articles as mentioned in the F.I.R. was recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or house. He has been falsely implicated in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case including the petitioner not having any criminal antecedent and having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Chainpur P.S. Case no.223 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cumSpecial Judge, Kaimur at Bhabhua.
