Earlier bail petition of the petitioner was rejected twice vide order dated 08.03.2013 and 05.02.2014.
Learned counsel for the petitioner submits that petitioner is jail custody since 24. 03. 2012. It is further submitted that some of the co-accused persons namely, Kamal Nayan @ Rupesh Sharma @ Raj Singh Rathour, Karpuri Thakur, Madan Mandal, Sanjay Mandal and Potna @ Ranjit Mahto @ Ranjit Mandal have been granted bail in Cr. Misc. No. 25873 of 2012, Cr. Misc. No. 28185 of 2012, Cr. Misc. no. 27346 of 2012, Cr. Misc. No.14310 of 2013 and Cr. Misc. No. 28238 of 2013 and the case of the petitioner is on similar footing.
Patna High Court Cr.Misc. No.32363 of 2014 (5) dt.24-06-2015 Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) on two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, Lakhisarai, in connection with Sessions Trial No. 678 of 2012 arising out of Piri Bazar P.S. Case No. 19 of 2012, subject to condition that petitioner will appear on each and every date fixed in this case and any absence of the petitioner shall be subject to satisfaction of the court below on reasonable ground. Further condition that petitioner will not remain absent on two consecutive dates. Further condition that one of bailor shall be a Government servant and other bailor shall be near relative of the petitioner.
