JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and learned Special Addl. Public Prosecutor for the State. The petitioner is not named in the FIR but it appears that in the course of investigation, the name of this petitioner surfaced in this case. Moreover, the witnesses claimed to have seen the petitioner and other accused following the deceased prior to the alleged occurrence.

Learned counsel for the petitioner points out that earlier the petitioner had filed a petition for grant of anticipatory bail but during the pendency of the aforesaid anticipatory bail petition, the petitioner surrendered and information regarding the aforesaid surrender could not be communicated to the Court by the Pairvikar of the petitioner as a result thereof the petitioner

Patna High Court Cr.Misc. No.45135 of 2015 (2) dt.29-09-2015 2/2 was granted the privilege of anticipatory bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that some co-accused having more or less similar allegation have already been granted the privilege of anticipatory bail, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Hathauri P.S. Case No. 02 of 2013 to the satisfaction of Sri Mukesh Kumar Mishra, J.M. 1st Class, Muzaffarpur.
