2. The petitioner is apprehending arrest in connection with Agiaon Bazar P.S. Case No. 34 of 2024 lodged on 27.03.2024, for the offences punishable under Sections 147, 149, 341, 323, 379, 307, 354, 448 of the Indian Penal Code.

3. As per the prosecution, FIR has been lodged against 10 named accused persons including the present petitioner. It has been alleged in the FIR that firstly, five accused persons have entered in the informant's house and started abusing her and also assaulted her and snatched some cash and jewellery. Thereafter, five other accused persons came and assaulted informant's devar and her neighbour with sticks (lathi & danda)

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that informant and accused persons are neighbours and they are well known to each other and due to long enmity, the said scuffling took place. Counsel submits that for the same date and place of occurrence, there is case and counter case i.e. one case has been lodged from the informant's side bearing Agiaon Bazar P.S. Case No. 34 of 2024 and one case has been lodged from the petitioner's side bearing Agiaon Bazar P.S. Case No.33 of 2024. Counsel further submits that there is general and omnibus allegation against the petitioner and he is ready to fulfill all the conditions whatsoever shall be imposed upon him. Counsel also submits that criminal antecedent of the petitioner is not clean as there is one case pending against him in which he is on bail.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that allegations made in the FIR is general and omnibus in nature.

6. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court

No.7269 of 2025(2) dt.19-02-2025 3/3 within a period of 4 weeks from today as well as on being satisfied by the Trial Court that the petitioner is not absconding in Agiaon Bazar P.S. Case No.117 of 2021, and on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-V, Bhojpur, Ara, in connection with Agiaon Bazar P.S. Case No. 34 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
