The petitioners seek bail in Paliganj P.S. Case no. 105/2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. Petitioners are named in the FIR but Petitioner no. 1 Rahis Kumar Yadav is alleged to have assaulted the informant Naulakh Kumar on his head with lathi. Sarif Yadav, Petitioner no. 2 and Dev Kumar Yadav assaulted Laldev Yadav with spade on his head. Petitioners are not assailants of Anil Yadav who succumbed to injuries. Naulakh Yadav got simple injury which would appear from Annexure-3.

However, learned counsel for the informant as well as learned Additional P.P. opposed the prayer for bail.

No.39494 of 2015 (2) dt.07-09-2015 2/2 Considering the facts aforesaid and the fact that on account of assault made by the petitioners, simple injuries are caused to Naulakh Yadav and Laldev Yadav, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Danapur, Patna, in connection with Paliganj P.S. Case No. 105/2014.
