The petitioner has filed the present Cr. Writ Petition to quash the F.I.R. bearing Begusarai Town (Ratanpur) P.S. Case No. 958 of 2022 lodged under Section 341, 342, 323, 384, 506 & 34 of the I.P.C. dated 27.12.2022 and also to protect the life, property and liberty of petitioner who is aged about 60 years. Learned counsel for the petitioner submits that the case in which name of petitioner has figured, has been filed on

Patna High Court CR. WJC No.226 of 2023(2) dt.12-04-2023 2/3 27.12.2022 particularly when petitioner has filed his representation before different authorities including Hon'ble the Chief Minister on 25.12.2022. He further submits that the persons who are disturbing are having political background and having group of muscleman, therefore, he needs protection from this Court.

Learned counsel for the respondents submits that petitioner may be directed to represent himself before the Superintendent of Police, Begusarai showing the entire material before him, who shall take decision in the light of order passed in the case of Surendra Singh Vs. State of Bihar and others on 09.09.2022 in Cr.W.J.C. No. 153 of 2017 with analogous cases. In this view of the matter, petitioner is directed to file representation before the Superintendent of Police, Begusarai in the light of order passed in the case of Surendra Singh Vs. State of Bihar and others on 09.09.2022 in Cr. W.J.C. No. 153 of 2017 with analogous cases within four weeks from the date of passing of this order.

The Superintendent of Police, Begusarai is directed to take necessary steps for completion of fair investigation at the earliest.

Till filing of final report under Section 173(6) of

Patna High Court CR. WJC No.226 of 2023(2) dt.12-04-2023 3/3 Cr.P.C., no coercive step shall be taken against the petitioner in connection with Begusarai Town (Ratanpur) P.S. Case No. 958 of 2022.

With the aforesaid direction, the present Cr. Writ Petition is hereby disposed off.
