The petitioners apprehend their arrest in connection with Balthar P.S. Case No. 61 of 2020 registered under Sections 366A, 380/34 of the Indian Penal Code and under Sections 8 and 14 of the POCSO Act.
Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Further submission is that during
Patna High Court CR. MISC. No.17783 of 2021(2) dt.04-01-2022 2/2 the course of investigation, the police did not find the case to be true against the petitioners and submitted final form against the petitioners. Petitioners have no criminal history. Having considered the above facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional District and Session Judge-1st cum Special Judge (POCSO), Bettiah, West Champaran in connection with Balthar P.S. Case No. 61 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
