The petitioner seeks bail in Chakiya P.S. Case No. 48 of 2014, registered for the offences punishable under Section 366A and other Sections of the Indian Penal Code. The informant made allegation that the petitioner along with Saddam kidnapped his minor daughter.

Learned counsel for the petitioner submits that Jubaida Khatoon, the victim made her statement under Section 164 of the Cr.P.C. and disclosed that she was in love with the petitioner for last three years and she wanted to marry with him that is why she voluntarily left her house and went along with the petitioner. The victim disclosed her age to be 20 years.

Patna High Court Cr.Misc. No.38198 of 2014 (3) dt.21-01-2015 Considering the facts aforesaid, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Chakiya P.S. Case No. 48 of 2014.
