JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-09-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners are not named in the first information report but in course of investigation, as per submission on behalf of the petitioner, it has only come that petitioners were seen taking wine in the company of FIR named accused on the alleged date of occurrence.

The contention on behalf of the petitioners is that FIR named accused persons were put on trial and they have already been acquitted and moreover, in course of trial of all the aforesaid accused, the informant has not supported the case. Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.40956 of 2015 (2) dt.11-09-2015 2/2 as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Madhepura (Parmanandpur O.P.) P.S. Case No. 313 of 2012 to the satisfaction of Chief Judicial Magistrate, Madhepura.
