The petitioner seeks bail in a case under Section 307 and other sections of the Indian Penal Code.
The informant alleged that while he, his brother and others had gone to see the fair some altercation took place. On such, Chandan Mahto assaulted his brother, Kundan Kumar, with knife. Chandan Mahto also assaulted Jyotish Kumar Mandal and Lalu Kumar Yadav. The petitioner and Murari Verma are said to have helped Chandan Mahto in fleeing away from the place of occurrence.
It is submitted that co-accused Murari Verma has
Patna High Court Cr.Misc. No.39830 of 2015 (2) dt.31-08-2015 2/2 already been enlarged on bail.
Mr. Ambika Bhagat, learned counsel for the informant, as well as the learned Additional Public Prosecutor submitted that in the later part of the FIR there is omnibus and general allegation of assault against the petitioner also but it appears that nobody got any injury. Kundan Kumar died on account of assault made by Chandan Mahto and Chandan Mahto also assaulted Jyotish Kumar Mandal and Lalu Kumar Yadav. It appears that there is no allegation of assault against the petitioner. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri A. K. Singh, learned Judicial Magistrate, 1st class, Jamui in Sikandra P.S. Case No. 62/2015. (Prabhat Kumar Jha, J) BKS/- U T
