The petitioner is languishing in custody since 17.3.2018 in a case registered for the offences punishable under Sections 399 and 402 of the I.P.C., Sections 20,21 and 22 of NDPS Act and Sections 25(1-B)a 26 and 35 of the Arms Act.

The prosecution case is that three persons were caught while fleeing away with robbed Bolero vehicle including the petitioner. From the possession of the petitioner, one country made loaded pistol and four cartridges and half kilogram ganja were recovered.

It is submitted by learned counsel for the petitioner that the petitioner is in custody since 17.3.2018 and the investigation has already been concluded. Moreover, co-accused Randhir Kumar alias Haddiya has been granted bail vide order dated 22.11.2018 passed in Cr. Misc. No.65993 of 2018.

Patna High Court Cr.Misc. No.8310 of 2019(2) dt.14-02-2019 2/2 Learned APP submits that recovery has been made from the petitioner.

Considering the fact that the investigation has already been concluded, co-accused Randhir Kumar alias Haddiya has been granted bail and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VIII, Patna in connection with Bakhtiyarpur P.S. Case No.136 of 2018.
