The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code and Section 8 of the Protection of Children From Sexual Offences Act.

It is alleged that minor niece of the informant has been abducted by all the F.I.R named accused

It is submitted by learned counsel for the petitioners that petitioners have falsely been implicated in this case since they are relatives of co-accused Niranjan Kumar with whom the victim was in love. The victim in her 164 Cr.P.C statement has recorded her age as 18 years and stated that she of her own sweet-will left her house and went along with co-accused Niranjan Kumar to Delhi where she solemnized marriage with him. She has not alleged any complicity of the petitioners in her elopement.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO-cumAdditional District Judge-VII, Bettiah, West Champaran
