The petitioner apprehends his arrest in Konch P.S. case No. 345 of 2018 registered under Section 30(a) of the Bihar Prohibition & Excise Act.
The informant alleged that petitioner and others were taking wine outside the house but after seeing the police they managed to flee away. Two liters of country made liquor is said to have been recovered in front of house of the petitioner. The learned counsel for the petitioner submits that petitioner has no knowledge about the liquor. Only two liquor of country made liquor is said to have been recovered that too in front of house of the petitioner.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above
Patna High Court Cr.Misc. No.7179 of 2019(2) dt.07-02-2019 2/2 named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Gaya in connection with Konch P.S. Case No. 345 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
