JUSTICE JITENDRA KUMAR ORAL ORDER 22-08-2025 The present Criminal Writ Petition has been preferred seeking direction to the Director General of Police, Bihar for complying with the order of the Human Rights Commission for conducting further inquiry into the allegations so as to identify the guilty police officials and take immediate disciplinary action against them.

2. The Petitioner has further sought direction to the police authorities to lodge criminal case against the guilty police officials under appropriate Section of the Indian Penal Code.

3. Heard learned counsel for the Petitioner and

Patna High Court CR. WJC No.313 of 2018(2) dt.22-08-2025 2/2 learned AC to SC-8.

4. In my considered opinion, the present Criminal Writ Petition is misconceived for compliance with the order of the Human Rights Commission. The Petitioner should contact Human Rights Commission for enforcement of its order. As far as lodging FIR is concerned, the Petitioner has efficacious remedy to lodge FIR or file appropriate Criminal Complaint against the guilty police officials.

5. At this stage, learned counsel for the Petitioner is seeking permission to withdraw the present petition with liberty to take appropriate step as required by the law.

6. Accordingly, the present petition is dismissed as withdrawn with liberty to the Petitioner to move appropriate application before the Human Rights Commission, before police or before the Judicial Magistrate.
