The petitioner seeks bail in a case registered for the offences punishable under Sections 420, 406, 467 and 468 of the Indian Penal Code.

The complainant stated in his complaint petition that the petitioner took Rs. 7,26,000/- for selling his Bolero Jeep bearing Registration No. BRO-05H-4864, but later on the complainant knew that the jeep was hypothecated. The petitioner did not pay the loan amount to his financer. The petitioner committed criminal breach of trust.

It is submitted that the complainant filed Money Suit No. 16 of 2004 for realization of the aforesaid amount. The

Patna High Court Cr.Misc. No.40097 of 2015 (2) dt.10-09-2015 2/2 criminal case is unwarranted.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Trial No. 1497 of 2014, arising out of Complaint Case No. C-877 of 2014.
