JUSTICE SATYAVRAT VERMA ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner and Mr. Rajendra Nath Pandey learned A.P.P. for the State. The petitioner seeks bail in connection with Sheohar P.S. Case No. 424 of 2021 instituted for the offences under Sections 30(a), 30(c), 30(d) of the Bihar Prohibition & Excise Act, 2016-18.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.12.2021, charge-sheet has been submitted in the case and has antecedent of one case and is a female and allegation is of recovery of 10 liters of liquor from a gallon.

Learned counsel for the petitioner submits that the house from which the liquor has been alleged to be recovered is a joint family property and as such petitioner is not knowing

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 07.12.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II cum Special Judge, Excise, Sheohar in connection with Sheohar P.S.
