JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 The petitioner seeks regular bail in connection with Special Case No. 01 of 2020/CIS No. 01/2020 arising out of Prosecution P.R. Case No. 181 of 2020, registered for offences punishable under Sections 27(b), (ii), 27(2) and 28 Drug and Cosmetic Act, 1940 and Section 21 (b) of the NDPS Act and Section 30(a) of the Bihar Excise (Amendment) Act, 2018. Allegation is of recovery of 7.100 litres of Coterex Syrup from the house of the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered either from the house of the petitioner or from his possession. Further he has no criminal antecedent and has been in judicial custody since 05.01.2020.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS Act, Purnea, in connection with Special Case No. 01 of 2020/CIS No. 01/2020 arising out of Prosecution P.R. Case No. 181 of 2020.
