The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, four accused persons on two motorcycles on the point of knife dispossessed the informant of his motorcycle and other articles as mentioned in the F.I.R.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against four unknown. The petitioner has falsely implicated in the case in course of investigation. The name of the petitioner transpired in the confessional statement of accused Bibhuti Kumar Paswan made

Patna High Court CR. MISC. No.17591 of 2021(2) dt.04-09-2021 2/2 before the police and the said Bibhuti Kumar Paswan has himself been enlarged on bail vide order dated 16.10.2020 (Annexure-2) passed in Cr. Misc. no. 26798 of 2020. The petitioner has no criminal antecedent and is in custody since 19.7.2019.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the grant of bail to coaccused Bibhuti Kumar Paswan on whose confessional statement the name of the petitioner transpired, the Court directs the petitioner to be enlarged on bail in connection with Kathaiya P.S. Case no. 42 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, West, Muzaffarpur.
