====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2023 Heard learned counsels for the petitioners and the State.
Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 308, 386 and 354(A) of the Indian Penal Code.
Petitioner No. 1 is alleged to have abused the informant in filthy language, petitioner No. 2 is alleged to have assaulted the nephew of the informant by means of lathi and petitioner No. 3 is alleged to have demanded rangdari. Learned counsel appearing for the petitioners submits that there is no specific allegation of assault against petitioner
Patna High Court CR. MISC. No.10941 of 2023(2) dt.16-05-2023 2/2 Nos. 1 and 3 and injury caused by petitioner No. 2 is simple in nature. Petitioners have got clean antecedent. Considering the nature of accusation and simple injury, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Laxmipur/Gidhour P. S. Case No. 203 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
