JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 The petitioner seeks regular bail in connection with Special Excise Case No. 1040 of 2020 arising out of Barhara P.S. Case No. 270 of 2019, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 150 litres of liquor from the scorpio vehicle of co-accused Chhotu Kumar, which was parked in front of house of said Chhotu Kumar and petitioner was arrested from there.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered from the petitioner rather the recovery has been made from the vehicle of Chhotu Kumar. Further he has no criminal antecedent and has been in judicial custody since 27.12.2019.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge-cum-Special Judge (Excise), Purnea in connection with Special Excise Case No. 1040 of 2020 arising out of Barhara P.S. Case No. 270 of 2019.
