JUSTICE ALOK KUMAR SINHA ORAL ORDER 18-06-2026 Heard learned counsel for the petitioner, learned counsel for the respondent-University and learned counsel for the respondent-State.

2. With the consent of both the parties, this writ application is being disposed of at this stage itself.

3. In the present writ application, the petitioner has prayed for the grant of following reliefs:

"(i) For issuance of direction to the respondent no. 2 to immediate approve

2/5 the letter no. 239/2025 issued by the respondent no. 5 as annexure-P/7 on 26.3.2025 in view of decision of syndicate and senate of Kameshwar Singh Darbhanga Sanskrit University, Darbhanga, for granting of approval to impart education of Honours with Shastri level in Dr.

Ramkrishna Thakur Janta Sanskrit College Ekahari Ladaniya of Madhubani district considering the facts that the permanent affiliation of the concerned college for imparting of education of "Shastri level in General" has been granted by the education department of govt. of Bihar vide memo no.

403 Patna dated 22.8.1995 issued by the Secretary of higher education from sessions 95 to as yet after granting prolong temporary affiliation from sessions 19891990 to 1994-1995. Which has been also approved by the syndicate of Kameshwar Singh Darbhanga Sanskrit University, Darbhanga dated 3.3.1997 and as such the respondent no. 3 pleased to make notification with regard to such aspect vide letter no. 3229/1997 dated 26.5.1997 as Annexure-P/1 series.

(ii). For issuance of direction to the respondent no. 3 to take instantly needful and necessary action with regard to grant approval for imparting of education of

3/5 Acharya level in Dr. Ramkrishna Thakur Janta Sanskrit College Ekhati Ladaniya of Madhubani district after considering the recommendation made by the inspection team of the university on 18.12.2021 in view of sufficient infrastructure of the college concerned as well as considering the geographical condition of the locality with regard to deficiency of Sanskrit education among the people alongwith insufficient Sanskrit institution of the locality whereas the "Dr. Ramkrishna Thakur Janta Sanskrit College Ekhari Ladahiya" is also an institution registered under section 2(F) and 12(B) of university grant commission New Delhi and having better infrastructure for imparting of education of Acharya level.

(iii). For issuance of direction to the respondent no. 3 to grant permission to the Dr. Ramkrishan Thakur Janta Sanskrit College Ekhari to fill up the application form of students in Shastri Honors for the session of 2025 to 2029 without making any obstruction after considering the future of students as well as considering the sufficient educational environment of the institution alongwith its infrastructure."

4. After advancing some argument, learned counsel

4/5 for the petitioner submits that for seeking the aforesaid reliefs, the petitioner is prepared to file a fresh representation before the Director of Higher Education Department, Govt. of Bihar, Patna (respondent no. 2). He further prays that an appropriate direction be issued to the Director of Higher Education Department, Govt. of Bihar, Patna to dispose of the representation which would be filed by the petitioner within a fixed time frame, after giving an opportunity of hearing to the petitioner.

5. To the aforesaid prayer being made by learned counsel for the petitioner, learned counsel appearing for the respondent-University and respondent-State do not have any objection.

Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of granting liberty to the petitioner to file a fresh representation before Director of Higher Education Department, Govt. of Bihar, Patna (respondent no. 2) within one month from today. If such a representation is filed within the stipulated time then the Director of Higher Education Department, Govt. of Bihar, Patna (respondent no. 2) is directed to dispose of the same within a period of six months from the date of receipt of

5/5 the representation, after giving an opportunity of hearing to the petitioner. Needless to emphasize that the final order which shall be passed by the Director of Higher Education Department, Govt. of Bihar, Patna (respondent no. 2) should be a reasoned and speaking order.

7. With the aforesaid observation/direction and liberty granted, this writ application is disposed of. All pending interlocutory application(s), if any, shall also be deemed to have been disposed of.
