For the Petitioner/s :

Mr. Krishna Chandra Ojha, Adv For the Opposite Party/s :

Mr. Umeshanand Pandit, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 09-05-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Piyar P.S. Case No. 140 of 2024, registered for the offence punishable under Sections 126(2), 115, 85, 103(1), 3(5) of B.N.S.

3. The case of the prosecution, in short, is that the daughter of the informant was married ten years back to one Kanchan Ram. After marriage, she was harassed for dowry by her husband and his family members. On 01.08.2024, she informed her mother about being abused and receiving death

Patna High Court CR. MISC. No.6234 of 2025(3) dt.09-05-2025 2/3 threats. The petitioners have beaten her on the incitement of her husband. On 02.08.2024, the villagers informed the informant that his daughter had been killed. Upon reaching her matrimonial house, her body was found and all family members had fled away.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Petitioner no. 1 is the Bhainsur, petitioner no. 2 is the gotni and petitioner no. 3 is the jaut of the deceased and they were living separately from the deceased. The petitioners have no criminal antecedent.

5. Learned A.P.P. for the State opposes the prayer of anticipatory bail.

6. From perusal of the records, it transpires that the informant and witnesses have supported the prosecution case and the witnesses have also said about harassment and dowry demand. There is clear allegation that on the incitement of the husband of the deceased, his family members including the petitioners have killed the deceased. The post-mortem report shows that the deceased died due to hanging. Considering the gravity of the offence alleged to have been committed by the petitioners, this Court is not inclined to grant privilege of

Patna High Court CR. MISC. No.6234 of 2025(3) dt.09-05-2025 3/3 anticipatory bail to the petitioners.

7.

Accordingly, the present anticipatory bail application stands rejected.
