The petitioner seeks bail in a case registered for the offences punishable under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

The informant widow of deceased Sudarshan Paswan disclosed that Rajiv Sah, Salen Yadav and Nirmal Yadav came and took her husband but her husband did not return. On the next day the dead body of her husband was found. The informant thereafter alleged that the petitioner along with other accused persons shot her husband dead. The informant is not an eye witness of the occurrence. The informant alleged that Rajiv Sah, Salen Yadav and Nirmal Yadav took her husband to somewhere else but did not name the petitioner. Patna High Court Cr.Misc. No.38636 of 2015 (2) dt.28-08-2015 suspicion named the petitioner. Similarly situated co-accused Sulendra Mehta has already been enlarged on bail vide Criminal Misc. No. 10392 of 2015. The case of the petitioner stands on the same footing.

Considering the facts aforesaid, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Sonbarsa Raj (Kash Nagar O.P.) P.S. Case No. 41 of 2014.
