2. The petitioner apprehends arrest in a case registered under Section 30(a) of Bihar Excise Act and Section 27 of the Arms Act.
3. As per prosecution case, it is alleged that all the FIRnamed accused persons fled away from the place of occurrence throwing the bags after seeing the police party. On search, 3564 liters of illicit liquor have been recovered from 99 bags. Petitioner has been identified by local Chaukidar.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on the confessional statement of local Chaukidar. Nothing has been recovered from
Patna High Court CR. MISC. No.6764 of 2025(2) dt.11-02-2025 2/2 the conscious possession of the petitioner. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State opposed the prayer for bail.

Having considered the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs. 10,000 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, Sitamarhi, in connection with Suppi P.S. Case No. 92 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
