The petitioner is languishing in custody since 28.12.2018 in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution, From the hutment of the petitioner, 81 litres of illicit Nepali liquor were recovered. It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Considering the quantity of recovery from the joint family house period under custody coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd cum Special Judge, Excise, Supaul in connection with P.R.
