The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 04 of 2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. After some arguments, learned advocate for the petitioner seeks permission to withdraw this anticipatory bail petition in order to enable the petitioner to surrender before the court below and seek bail.

Should such an application be filed, the court below shall take into account that the recovery was made from Khalihan which is in joint possession of all the family members and that the petitioner is a student who is appearing in competitive examination and has a
