2. Petitioner seeks bail who is in custody since 21.05.2022 in connection with Patrakar Nagar P.S. Case No. 258 of 2022, F.I.R. dated 17.05.2022 for the offences punishable under Sections 376, 302/34 of the Indian Penal Code.

3. According to prosecution case, this petitioner along with one other accused person have committed rape upon the daughter of the informant and then murdered her.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits on instruction

Patna High Court CR. MISC. No.7042 of 2023(12) dt.18-07-2024 2/2 that the evidence has closed and all the witnesses have been examined and the case is pending for argument.

5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner.

6. Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail in connection with Patrakar Nagar P.S. Case No. 258 of 2022 pending in the court of learned Additional District Judge XI, Patna.

7. Prayer is refused.

8. However, learned Trial Court is directed to expedite and conclude the trial at the earliest.
