Let the defects be removed within four weeks after start of the physical Court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 347, 420, 406, 409 and 120(B)/34 of the Indian Penal Code.

Informant is Ward Member of the Panchayat. In the FIR, he has levelled allegation against the petitioner being the Mukhiya as well as against the Panchayat Secretary that they obtained signature of the informant on blank cheques and the money was withdrawn without completion of the work. Submission is that the annexed papers would show that the work was completed and thereafter payment was made and it is highly unbelievable that a responsible person would sign on blank cheque and made allegation only after encashment

Patna High Court CR. MISC. No.17804 of 2021(2) dt.10-08-2021 2/2 of the cheque after completion of the work. Petitioner is in custody since 22.06.2020. Investigation of the case against the petitioner is already complete.

Considering the facts of this case, especially, period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rudrapur Police Station Case No. 137 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
