2. The petitioner seeks bail in connection with Sahebganj P.S. Case No. 566 of 2024 registered for the offence punishable under Sections 103(1), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner is said to have killed the deceased.
4. Learned Senior counsel for the petitioner has submitted that after 11 days, the son of the deceased has confessed that he has killed his father.
5. Learned APP appearing for the State and learned counsel for the informant have opposed the prayer for regular
Patna High Court CR. MISC. No.7833 of 2025(5) dt.02-07-2025 2/2 bail of the petitioner.
6. Just because there is a confession of the son of the deceased, the petitioner cannot be granted bail. One of the murder weapon i.e., revolver has been recovered from the son of the deceased. The petitioner is in custody since 09.11.2024.
7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class (West) Muzaffarpur in connection with Sahebganj P.S. Case No. 566 of 2024.
