====================================================== CORAM: HONOURABLE MR. JUSTICE GOPAL PRASAD ORAL ORDER 27-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

This is a petition for grant of regular bail in a case under Sections 324, 307 and 302/34 of the Indian Penal Code as well as Section 27 of the Arms Act in connection with Atari P.S. Case No. 126 of 2011 pending in the Court of Judicial Magistrate1st Class, Gaya. The prayer for bail on behalf of the petitioner was earlier rejected vide order dated 17.12.2013 passed in Cr. Misc. No. 12656 of 2013.

A report has been called for from the trial Court and it has been reported that the charge has been framed and thereafter summons have been issued for appearance of the witnesses and till date five witnesses are yet to be examined.

Patna High Court Cr.Misc. No.37820 of 2014 (3) dt.27-01-2016 Hence, the trial court is directed to ensure the attendance of the witnesses by taking coercive steps against the witnesses through the Superintendent of Police, Gaya and the Superintendent of Police, Gaya is also directed to ensure the attendance of the witnesses on the date fixed for early disposal of the case. Let this order be communicated to the Court concerned and the Superintendent of Police, Gaya for compliance. With this observation, this petition is dismissed. Kundan/- (Gopal Prasad, J) U
