JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-02-2019 The petitioner seeks bail in anticipation of his arrest in connection with Kumar-Khand (Belari O.P.) P.S. Case No. 117 of 2018, dated 16.06.2018, instituted for the offences under Section 414 of the Indian Penal Code. The petitioner along with three others is said to have been riding a motorcycle which was found to be a stolen one.
The learned counsel for the petitioner has submitted that he has not been arrested on the spot, which necessarily implies that he has only been named by some of the persons who have definite animus against him. It is also
Patna High Court Cr.Misc. No.6886 of 2019(2) dt.06-02-2019 2/2 not certain from the narration made in the F.I.R. as to how the informant, who is a police personnel, has come to know that the motorcycle which was left behind by the accused persons was a stolen property.
Regard being had to the aforesaid vague nature of accusation against the petitioner and his being a person of clean antecedent, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhepura in connection with Kumar-Khand (Belari O.P.) P.S. Case No. 117 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
