The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Submission is that civil suit is going on between the parties and for that reason in the past also a criminal case was lodged against the petitioners. Further submission is that though there is allegation of firing which hit at different parts of the

Patna High Court Cr.Misc. No.9946 of 2019(2) dt.19-02-2019 2/2 vehicle of the informant. However during investigation no sign of any shot hitting the vehicle was found which would be evident from the impugned order also.

Considering the facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Sour Bazar Police Station Case No. 599 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
