====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-02-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners seek regular bail in connection with Punpun P. S. Case No. 63 of 2020 registered for the offences punishable under Sections 447, 341, 323, 325, 307, 379, 504, 506/34 of the Indian Penal Code.

3. Allegation against petitioners is that they along with other accused persons assaulted father of the informant by means of lathi, bricks due to which he sustained injuries and died during course of treatment.

4. Learned counsel for the petitioners submits that quarrel took place between the parties, due to trivial issue, in

Patna High Court CR. MISC. No.7529 of 2026(2) dt.16-02-2026 2/2 which both sides inflicted injuries on each other. Case and counter case. Allegation of assault against the petitioners is general and omnibus and there is no allegation of any overt act against them. Petitioners claim clean antecedent and are in custody since 10.10.2025.

5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.

6. Considering the nature of allegation, clean antecedent and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Masaurhi at Patna in connection with Punpun P. S. Case No. 63 of 2020.
