JUSTICE SUDHIR SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 328, 307, 380 and 411 of the Indian Penal Code. Allegation against the petitioner is that he disappeared with the belongings of the informant and his wife, while they were traveling in a train, by making them unconscious after serving tea. It has been submitted on behalf of the petitioner that he is in custody since 21.4.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the F.I.R. Petitioner has been made accused due to mistake of fact. It is further submitted that petitioner may be released after completion of nine months in custody from 21.4.2015.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R. but has been identified in course of T.I.P. by the victim and his wife.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.40434 of 2015 (3) dt.14-10-2015 2 / 2 above named petitioner be released on bail after completion of nine months in custody from 21.4.2015 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Katihar, in connection with Katihar Rail P.S. Case no. 10 of 2015.
