2. The petitioners are in custody in connection with Sirdala P.S Case No. 421 of 2024 registered for the offences punishable under Sections 126(2), 115(2), 137(2), 140(3), 143(2), 352, 351(2), 3(5) BNS 2023.
3. As per prosecution case, petitioners along with coaccused have kidnapped the son of the informant.
4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. It is further submitted that petitioners have got no criminal antecedent as stated in para 3 of the bail petition. It is also submitted that
Patna High Court CR. MISC. No.7024 of 2025(3) dt.19-04-2025 2/2 petitioners are in judicial custody since 14.11.2024.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioners.
6. On perusal of the FIR impugned order, case diary it appears that, victim recovered from the house of petitioner no. 2, namely, Geeta Devi but no witness has been examined in this regard for recovery of the victim from the house of the Geeta Devi. It is also appears that investigation is already concluded and charge-sheet submitted accordingly. The Investigating Officer has not examined all the victim and no statement has been recorded under Section 183 of B.N.S.S.
7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioners, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Magistrate First Class, Nawada in connection with Sirdala P.S Case No. 421 of 2024.
