JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 21-01-2015 The petitioner is the husband and in custody since 17.07.2014 in relation to Sour Bazar (Patarghat O.P.) P.S. Case No.519 of 2013 instituted under Sections-304B and 120B of the Indian Penal Code.
Learned counsel for the petitioner points out that though the wife of the petitioner died in January, 2012, the complaint was lodged on 23.07.2012 after six months. Thereafter, the complainant has filed an application in the Court clearly stating that due to misapprehension of facts the prosecution was lodged.
Be that as it may, the petitioner, namely, Santosh
Patna High Court Cr.Misc. No.39810 of 2014 (03) dt.21-01-2015 2/2 Thakur shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Saharsa in connection with Sour Bazar P.S. Case No.519 of 2013 dated 14.11.2013.
