The petitioners seek regular bail in Asthawan P.S. Case No. 92 of 2013 registered under Sections 353, 385, 504, 506 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioner no. 1 is a Ward Member and Ex-officio President of Shiksha Samiti of the school. When the petitioners objected for using sub-standard materials for construction of the school, the informant filed a complaint case making false and frivolous allegations, on the basis of which, the present F.I.R. was lodged. It appears that only demand was made by the petitioners. The petitioner no. 1 is also an elected member of the

Patna High Court Cr.Misc. No.38501 of 2014 (2) dt.30-01-2015 2/2 ward.

Considering the facts aforesaid and the nature of allegation and the fact that the petitioners are in jail since 06.08.2014, the above named petitioners are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Bipin Kumar, Judicial Magistrate 1st Class, Nalanda at Biharsharif in Asthawan P.S.
