JUSTICE BIRENDRA KUMAR ORAL ORDER 07-09-2017 This civil revision application has been preferred against order dated 01.03.2012 passed in Matrimonial Case No.83/2010 by the learned Principal Judge, Family Court, Nawada, whereby the prayer of opposite party Pintu Kumar for a decree for restitution of conjugal right has been allowed.

The petitioner is appearing in-person.

Earlier Cr. Revision No.599 of 2017 was filed by the petitioner. Vide Annexure-3, the petitioner withdrew the aforesaid application with liberty to seek remedy in accordance with law. Thereafter, the present civil revision application has been filed under Section 19(4) of the Family Courts Act. Again the petitioner appears in-person and prays for permission to convert this application as miscellaneous appeal.

Patna High Court C.R. No.159 of 2017 (2) dt.07-09-2017 Prayer is allowed.

The petitioner is directed to correct the provision of law also wherein the miscellaneous appeal is maintainable.
