The petitioner seeks bail in a case under Section 420, 467 and other sections of the Indian Penal Code and under section 7 of the E. C. Act.
The petitioner is the driver of the tanker. It is alleged that the tanker was going towards Sitamarhi after loading illegal kerosene oil on forged documents.
It is submitted that petitioner is not at all responsible for any forged document and on the order of the owner of the tanker he loaded the kerosene oil and he was taking it to Sitamarhi. The police did not name the petitioner. The police filed requisition for issuance of warrant against the petitioner in the year 2014 although the case was lodged in the year 2009. The
Patna High Court Cr.Misc. No.41273 of 2015 (2) dt.09-09-2015 2/2 owner of the vehicle, Umesh Prasad Singh, has already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 17111 of 2009. The petitioner is in jail since 03.07.2015. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Dumra P.S. Case No. 27/2009 (G. R. No. 206/2009).
