JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Pear (Hatha O.P.) P.S. Case No. 155 of 2018, registered for the offences punishable under Sections 414/34 of the Indian Penal Code.

Allegation as per FIR is that police recovered one motorcycle from one co-accused, who disclosed the names of two other persons and from their possession a motorcycle was recovered and one of them has disclosed the name of the petitioner as the same was purchased from him. Submission of learned counsel for the petitioner is that there is no chit of paper to show that the co-accused has purchased the motorcycle from the petitioner and petitioner has no criminal antecedent.

No.6527 of 2019(3) dt.02-04-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Ms. Romi Kumari, Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Pear (Hatha O.P.) P.S. Case No. 155 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
