Petitioners are in custody since April, 2014 in relation to Siwaipatti Police Station (PS) Case No 36 of 2014 dated 21.04.2014 instituted, inter alia, under Section 326A of Indian Penal Code. The investigation has concluded. Chargesheet has been filed and the trial is pending. Petitioners No 1 and 2 are sons of petitioner No 3 who is about 70 years of age. In the first information report, apart from these three petitioners, the wife of petitioner No 3 that is the mother of petitioners No 1 and 2 had also been made an accused. It is alleged that when the victim girl stepped out of her house, the three petitioners, who were on the roof of that house, threw acid on her because of enmity. Learned

Patna High Court Cr.Misc. No.39036 of 2014 (2) dt.20-01-2015 counsel for the informant submits that because the petitioners wanted one of their relations to get married to a boy with whom the marriage could not be solemnized but was fixed with the victim, they had taken revenge. They are closely related. Learned counsel for the petitioners submits that apart from other things how the petitioners manage to climb on the roof of informant's house is not at all stated. Petitioners stay in a separate house. Be that as it may, considering that the petitioners abovenamed are in custody since April, 2014, they are directed to be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Subdivisional Judicial Magistrate, East Muzaffarpur in Siwaipatti PS Case No 36 of 2014.
