====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 07-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bye-Pass P.S. Case No. 253 of 2018, instituted for the offence under Section(s) 394 of the Indian Penal Code.

Counsel for the petitioner submits that co-accused Nitish Kumar Bind with similar allegation has already been granted bail by this Court vide order dated 23.01.2019 passed in Cr. Misc. 2923 of 2019.

It is alleged in the written report that on the date of occurrence informant was returning after taking picture of hoarding of Tata Motors then four persons arrived and caught hold him and snatched his mobile phone and cash of Rs.1,500/-. When informant raised alarm accused persons fled

Patna High Court Cr.Misc. No.7187 of 2019(2) dt.07-02-2019 2/2 away. Thereafter, some of the Muhalla people arrived there. Informant narrated them about the incident. It is further alleged that one person showed picture of some persons to informant, out of which, informant identified the petitioner. Learned counsel for the petitioner submits that informant has not disclosed name of the person who had showed him the photographs on his Mobile.

Petitioner is in custody since 22.8.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Patna City, Patna, in connection with Bye-Pass P.S. Case No. 253 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
