2. In the present case, the petitioner seeks bail in connection with Ara Nawada P.S. Case No. 755 of 2024 for the offences punishable under Sections 109 (1), 3 (5) of BNS and Section 27 of the Arms Act.

3. As per prosecution case, co-accused Ritik Kumar along with his 5-6 associates came to Puja Pandal and started misbehaving with ladies and girls. The members of Durga Puja Committee asked the co-accused and his associates not to indulge in such kind of activity. They became enraged and they returned with their associates and opened fire at the Puja Pandal causing injuries to the informant and three other persons. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is not named in the FIR and his name came up in the statement of co-accused persons. The petitioner has no concern with the accused persons nor with the alleged occurrence and nothing has been recovered from the person/possession of the petitioner. The learned counsel further submits that the petitioner himself informed the members of Durga Puja Committee about indecent act of Ritik Kumar and Manish Kumar and in order to teach the petitioner lesson, the co-accused named him in the present case. The learned counsel further submits that no serious injuries were caused and this petitioner is having clean antecedent and is in custody since 12.11.2024 and charge sheet has been submitted.

5. Learned APP vehemently opposes the submission made on behalf of the petitioner.

6. Having regard to the facts and circumstances of the case and submissions made on behalf of the parties and considering the fact that the petitioner was not initially named and further considering the period of custody of the petitioner, submission of charge sheet and his clean antecedent, the

No.6292 of 2025(3) dt.14-05-2025 3/3 petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Ara Nawada P.S. Case No. 755 of 2024, subject to the conditions mentioned in Section 480 (3) of BNSS and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bonds of the petitioner will be liable to be cancelled by the court concerned.
