The petitioners seek bail in connection with Chowk P.S. Case No. 07 of 2022 instituted for the offences under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 07.01.2022, are persons with clean antecedent and charge-sheet has been submitted in the case.

Learned counsel for the petitioners submits that the allegation is of recovery of 43 litres of liquor from the house of petitioner no. 2 and 89.88 litres of liquor from petitioner no. 1.

Learned A.P.P. for the State opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody, are persons with clean antecedent, charge-sheet has been submitted in the case and were not arrested from the spot, let the petitioners above named be released on bail on furnishing bail bond of Rs. 1,000/- (Rupees One Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna City, Patna in connection with Chowk P.S. Case No. 07 of 2022.
