According to prosecution case itself, the alleged occurrence took place on 19-06-2013 and on the next date of alleged occurrence, the informant got information regarding the alleged occurrence but he gave written report on 22-06-2013. Moreover, none of the present witness claimed to have seen the actual killing of the deceased and in course of investigation, it came to light that petitioner was co-owner of the truck, which had met accident with the truck of the deceased.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court Cr.Misc. No.38864 of 2015 (4) dt.09-11-2015 (ten thousand) with two sureties of the like amount each in connection with Sarai P.S. Case No. 104 of 2013 to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
