The petitioner seeks bail in connection with Jandaha P. S. Case No.210 of 2021, instituted for the offences under Sections 414, 272, 273 of the Indian Penal Code and Section 30(a) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 23.09.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 100 litre of liquor from a motorcycle.

The learned counsel for the petitioner submits that petitioner is the owner of the motorcycle and yet parked his

Patna High Court CR. MISC. No.8298 of 2022(2) dt.09-03-2022 2/2 motorcycle and had gone to a shop and when he came back, he saw the police standing near the motorcycle. It appears that someone had left the bag on the motorcycle and fled after seeing the police and the petitioner came to be implicated. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IInd-cum-Excise Court, Vaishali at Hajipur in connection with Jandaha P. S. Case No.210 of 2021.

The application stands allowed.
